Now, this is one jury duty I'd be more than willing to serve.
A New York judge has cleared the way for the bare-but-for-underpants 'Naked Cowboy' - who performs for tourists in Times Square - to sue Mars, Inc. (makers of M&Ms) for trademark infringement. A story on CNN today explains that "in February, the street performer filed a lawsuit against Mars Inc. and Chute Gerdeman Inc., after they released a video billboard showing a guitar-playing blue M&M dressed in a white cowboy hat, cowboy boots and underpants."
Mars, Inc.., its ad agency and attorneys are insisting the figure could be ANY generic guitar-playing character in white cowboy hat, cowboy boots and underpants. Of course, the 'Naked Cowboy' and his lawyers disagree, contending that his is a signature look, protected by law.
All I want to know is how the 'Cowboy' keeps his tidy whities so darned clean.
